Terms & Conditions
1.1 The sponsor/promoter of all competitions hosted on www.queensberryline.com is “Queensberry Line Ltd” whose Company Registration Number is 12942293 and Registered address is at St. Curig's, Capel Curig, Betws-y-coed, Conwy, LL24 0EL, United Kingdom, and from hereon-in referred to as ‘The Queensberry Line’, ‘The QBL’, ‘the promoter’, ‘we’ or ‘us’.
2. Laws & Regulations
2.1 While we commonly utilise the term ‘giveaway’ in our promotional materials, this promotion is legally considered to be a “Prize Competition”, due to the fact that each entrant is required to answer a question or puzzle upon entering. For further information about the laws and regulations on raffles and prize competitions in the United Kingdom, please visit www.gamblingcommission.gov.uk.
2.2 By entering our ‘giveaway’/Prize Competition, the entrant ('Entrant', 'you', 'your(s)') will be deemed to have legal capacity to do so, you agree that you have read and understood these Terms and Conditions and that you will be bound by them and by any other requirements set out in any related promotional material from The Queensberry Line.
2.3 These ‘giveaways’/Prize Competitions are governed by English Law and any matters relating to the Competition will be resolved under British Law and the British Courts shall have exclusive jurisdiction.
2.4 At such time as you participate in a ‘giveaway’/Prize Competition online via the Website, and by accepting these Terms and Conditions, you confirm that you are not breaching any laws in your country of residence insofar as the legality of entering our giveaway. The Promoter will not be held responsible for any Entrant entering any of our ‘giveaways’ unlawfully. If in any doubt you should check with the relevant authorities in your country before any entries are filed.
3. Competition Entry
3.1 The first two prizes available in our ‘giveaway’/Prize Competition are a right-hand hand drive, black, 2020 Audi RS7 luxury car, and a Husqvarna dirt bike.
3.2 Our ‘giveaway’/Prize Competition must be entered from The Queensberry Line’s official website, “www.queensberryline.com”. Any other websites or promoters claiming to be participating in our Competition are spurious, and The QBL is not responsible or at fault for any loss of funds or information that occur forthwith.
3.3 Entry into the Competition is via the mechanism of purchases from The Queensberry Line’s official merchandise line. Upon purchase, the Entrant will be required to answer a question or puzzle. Correct response guarantees a single entry into the Competition.
3.4 Additionally, entries can be purchased individually, without a merchandise purchase, for the cost of four GBP for the dirt bike Competition, and eight GBP for the RS7 Competition.
3.5 Only individuals aged 18+ are eligible for entry into this Competition, and any Entrant for the car without a valid Driving License will not be permitted to operate the vehicle until one is legally acquired.
4. Promotion Period
4.1 The promotion period runs until 31st October 2021 at 23:59 (GMT) or until all tickets have sold. Entries MUST be received by 23:59 this date, or they will be invalid.
5. Winner Selection
5.1 The winner(s) will be picked randomly once the competition has finished. The website uses a secure coded function that provides total randomization for the purpose of selecting a winner.
6. Winner Notification
6.1 The winner be notified within 24 hours of the winner being selected. They will have 7 days in which the winner must acknowledge and respond to the QBL, after which the drawing will occur again for a new winner.
7. Prize Giveaway Threshold
7.1 The minimum threshold of tickets for the Audi RS7 giveaway is 15,000 (fifteen thousand). The minimum threshold of tickets for the Husqvarna is 1,750 (one thousand seven hundred and fifty). If we don’t meet the threshold, then in place of the Audi RS7 or the Husqvarna dirt bike, the Competition winner will receive 80% of the ticket revenue garnered. The vehicles will then be sold in a traditional setting.
8. Delivery / Collection
8.1 Prize delivery within the UK is provided free of charge to the Winner of the Competition by The Queensberry Line within one week of the competition ending. Collection of prizes is also available from Capel Curig, Snowdonia, Wales. Shipping abroad is only available at cost of prize Winner, who also must assume any import fees or taxes.
9. Acceptance / Dispute
9.1 The winner has one week after delivery to ‘Accept’ or ‘Dispute’ the prize.
9.2 ’Accept’ – confirms that the prize is as advertised and possession of it has been taken. At that moment the ‘giveaway’/Prize Competition is considered complete and closed.
9.3 ’Dispute’ – confirms that the prize is not as advertised, or that possession of it has not been taken. In which case an outside resolution service will be employed to negotiate any issues.
9.4 If the winner neither ‘accepts’ nor ‘disputes’ the prize within 21 days of the End Date of the Competition, we reserve the right to withdraw the prize from the winner and select a replacement winner at random.
10. Limits of Liability
10.1 The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prizes. Except for liability for death or personal injury caused by the negligence of the Promoter, the Promoter shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the prize Winner(s) and, where applicable, to any family/persons accompanying the Winner(s), or in connection with any of the Competitions promoted by the Promoter.
11. Electronic Communications
11.1 No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet accessibility or availability or for traffic congestion or unauthorised human act, including any errors or mistakes. The Promoter shall use its best endeavours to award the prize for a Competition to the correct Entrant. If due to reasons of hardware, software or other computer related failure, or due to human error the prize is awarded incorrectly, the Promoter reserves the right to reclaim the Competition prize and award it to the correct Entrant, at its sole discretion and without admission of liability.
11.2 The Promoter may in its sole discretion cancel, terminate, modify or suspend a Competition, or invalidate any affected entries
11.3 The Promoter shall use its best endeavours to ensure that the software and website(s) used to operate its Competitions perform correctly and accurately across the latest versions of popular internet, tablet and mobile browsers.
12. Data Protection Notice
12.1 Any personal data that you supply to the Promoter or authorise the Promoter to obtain from a third party, for example, a credit card company, will be used by the Promoter to administer the Competition and fulfil prizes where applicable.
12.2 In order to process, record and use your personal data, the Promoter may disclose it to (i) any credit card company whose name you give; (ii) any person to whom the Promoter proposes to transfer any of the Promoter's rights and/or responsibilities under any agreement the Promoter may have with you; (iii) any person to whom the Promoter proposes to transfer its business or any part of it; (iv) comply with any legal or regulatory requirement of the Promoter in any country; and (v) prevent, detect or prosecute fraud and other crime. In order to process, use, record and disclose your personal data the Promoter may need to transfer such information outside the United Kingdom, in which event the Promoter is responsible for ensuring that your personal data continues to be adequately protected during the course of such transfer.
